MIDDLETOWN CAR ACCIDENT - A township woman who broke her foot, ankle and knee in a car accident was awarded almost $1 million in a personal injury lawsuit that concluded last week, said her car accident lawyer.
The 49 year old woman and her husband, were awarded $ 943,095 after a four-day trial in the U.S District Court in Trenton, said GERALD JAY POMERANTZ, an attorney with offices in Philadelphia who represented the woman with his partner, ELIOT HILLEL LEWIS.
The woman, who declined to comment on the case, is a guidance counselor in the Hopewell Valley School District in New Jersey. She was injured in a July 13 1989 accident in Pennington, NJ. when a truck spun out of control on State Highway 81 near East Delaware Ave. striking her Toyota Camry. POMERANTZ said.
She broke her left foot and ankle and fractured her right kneecap, he said, and filed a lawsuit against the driver of the truck Ernesto Cardenas, no known address, and the owner of the trucking company that employed Cardenas, John Hart Jr. of Pennington.
The suit was tried before Federal Judge Clarkson Fisher, The Courier Times was unsuccessful in contacting court officials. According To POMERANTZ, the jury deliberated for about 40 minutes.
According to POMERANTZ, the woman spent 12 days in the hospital and, though she can walk, now has progressive arthritis in her knee and foot that eventually will require surgery. She continues to work, he said, but is "permanently in pain."
